6. Community & Events

6.1 Community Participation

curiously positive (+IVE) may host online forums, social spaces, challenges, or community boards. By participating, you agree to engage respectfully and constructively. You must not post content that is defamatory, obscene, threatening, infringing on intellectual property rights, or otherwise unlawful.

6.2 Events

For in-person or virtual events organised by our authorised partners or us, additional event-specific terms may apply and will be communicated at the time of registration. Attendance at events may involve photography, videography, and social media coverage by us. By attending, you grant us a non-exclusive, royalty-free, worldwide licence to use event imagery for marketing purposes unless you opt out in writing prior to the event.

6.3 User-Generated Content

By submitting reviews, photos, testimonials, or other content to our Platform ("UGC"), you grant curiously positive (+IVE) a perpetual, irrevocable, royalty-free, worldwide licence to use, display, reproduce, adapt, and distribute such UGC for our marketing and operational purposes. You warrant that you own or have all necessary rights to submit such content and that it does not infringe any third-party rights.

6.4 Referral & Loyalty Programmes

Referral credits and loyalty points are subject to programme-specific terms made available at the time of participation. They hold no cash value unless expressly stated, are non-transferable, and expire per the programme terms.

 

7. Intellectual Property

All content on the Platform, including but not limited to the curiously positive (+IVE) name, logo, brand identity, product formulations, website design, text, graphics, and software, is owned by or licensed to us and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent. Any unauthorised use may expose you to legal liability.

 

8. Prohibited Conduct

You agree not to:

You agree to indemnify, defend, and hold harmless curiously positive (+IVE) and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way related to: (a) your use of the Platform; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in New Delhi, India. The language of arbitration shall be English.

 

17. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver. These Terms, together with our Privacy Policy and any additional programme-specific terms, constitute the entire agreement between you and curiously positive (+IVE) regarding your use of the Platform.
